Getting a new technician started in Colorado
Colorado Medicaid requires BACB RBT registration for 97153 billing, and a statewide RBT shortage is reported (COABA FAQ: about 5,589 RBTs, estimated 2,000 short), so a newly hired BT who is not yet registered may have limited billable work under Medicaid beyond the temporary window in HB26-1425. Confirm current rule with HCPF. (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- HCPF pages (PBT Emergency Rule, 2025-12-22 compliance update, PBT billing manual) returned 403: confirm the current RBT compliance date, the emergency rule text and any new-hire window.
- How the 45-day temporary period in HB26-1425 works and when it takes effect.
- Exact C.R.S. 10-16-104 text: age limits, caps, self-funded treatment.
- Telehealth rules for ABA direct service and supervision (Medicaid and commercial).
- Major commercial/Medicaid payers (RAEs) and provider enrollment URL.
- Licensure fees/application process for the new behavior analyst license.
- HCPF production pages returned 403. The PBT billing manual was read through HCPF's state-hosted test mirror, but the current RBT compliance date, emergency rule text and any new-hire window remain unverified.
- How the 45-day temporary period in HB26-1425 works and when it takes effect, including the federal approval and specified conditions identified in the bill summary.
- The explicit no-age-cap interpretation is supported by Autism Speaks; the 2026 statute retains child wording in subsection (1.4) alongside broader ASD parity coverage in subsection (5.5). A current DOI interpretation reconciling these provisions was not obtained.
- The telemedicine mirror's last listed revision is 2025-05-09. Confirm whether later HCPF publications changed ABA code eligibility, modalities, consent or billing instructions as of 2026-10-21.
- Colorado Medicaid and commercial payer restrictions on remote technician supervision, supervision-only reimbursement and concurrent 97153/97155 billing remain unverified. BACB permission for video supervision does not establish payer reimbursement.
- Commercial technician qualifications in the insurance statute are now documented in autism_insurance_mandate. The unchanged bt_vs_rbt section reflects the earlier research scope; plan-specific rules for unregistered BTs, alternative credentials and billing remain unverified.
- medicaid_aba: verifier astra marked conflict - Coverage, program name, age and EPSDT criteria are supported by the opened official test-site manual; its revision log ends in 2024, so it does not establish current credential enforcement. The release and retroactivity dates are supported as COABA's account, not independently verified from PM 25-005. CONFLICT: BACB-exclusive certification is contradicted by HCPF's archived August bulletin. HB26-1425 also recognizes BACB, QABA and qualifying board-designated certifiers; statutory supervisors include a licensed psychologist, BCBA, BCBA-D or BCaBA. Replace categorical rbt_required_for_technicians='yes' with qualified wording. Add the October 31, 2025 historical extension. UNSUPPORTED under the required opened-page standard: December 12 deadline, December 22 withdrawal/new-date announcement, and December 12 emergency adoption of MSB 25-09-04-A; originals and attempted alternate copies were inaccessible. Search snippets are insufficient. The 45-day statutory provision is conditional, as detailed in bt_vs_rbt. Current implementation and federal approval were not verified. No telehealth or treatment-cap claim was supplied.
- bcba_licensure: verifier astra marked conflict - Set state_license_required=false as of 2026-10-21, with a separate future requirement effective 2028-07-01. The law is enacted; the practitioner licensing mandate and associated offense are deferred. The titles, DORA board, certification requirement, fingerprint check, assistant supervision, signing date, chapter and scheduled sunset are supported by the opened legislative materials. Add the professional-liability-insurance exception for qualifying public employees covered by governmental immunity. The misdemeanor applies to nonexempt practice after the relevant provision takes effect. Cite C.R.S. article 12-247, particularly sections 106–109, 112, 118 and 122–123. No established fee schedule, operational application process or dedicated board URL was verified; fiscal-note estimates should not populate those fields.
- bt_vs_rbt: verifier astra marked conflict - Keep 'conditional,' but remove the implication that every reimbursable technician must hold BACB's RBT credential. Under C.R.S. 25.5-4-437(3), temporary reimbursement requires federal approval, quarterly employer rosters, a name-based judicial check, completed certification training and abuse/neglect-reporting training. The clock starts after those prerequisites. Although subsection (3)(a) says at least 45 days, subsection (3)(c) expressly stops reimbursement requests after 45 days without certification, until certification occurs. Do not describe an automatically available hiring grace period; implementation was not verified. Populate the empty requirements list with these conditions. Commercial-insurance eligibility remains unverified; the Medicaid findings cannot establish it.
- practice_requirements: verifier astra marked conflict - Specify ages at least 18 months and under 21, and 4–<24 hours of care each business day. ABA-clinic and day-treatment definitions differ; the statutory transition deadlines concern newly qualifying day-treatment facilities. CDHS nevertheless explicitly instructs operating/unlicensed ABA clinics to apply by August 1, 2026 and obtain licensure or cease operations by August 1, 2027; retain that guidance with its scope. Change 'after August 1' to 'on or after August 1.' Background-check and training fields are incomplete: add the technician prerequisites identified in bt_vs_rbt and clinic staff checks. HCPF technician reimbursement conditions and CDHS facility licensing checks are separate obligations. DHS authority over clinic standards is supported; it does not establish a complete, currently operative staff-training curriculum.
