- Notes
As of 2026-10-21, the statute applies to a health plan issued to a large employer (as defined in section 62Q.18, subd. 1) and requires coverage of diagnosis, evaluation, multidisciplinary assessment and medically necessary care, including early intensive behavioral and developmental therapy such as all types of applied behavior analysis, per an individualized treatment plan prescribed by the treating physician or mental health professional. A carrier may generally request an updated treatment plan only once every six months, but subd. 2(e) permits more frequent review when the carrier and the treating physician or mental health professional agree it is necessary because of emerging circumstances. An independent progress evaluation by a qualified mental health professional is required. The reviewed text specifies no dollar cap; this does not establish that benefits are unlimited. The 2021 amendment to the definitions in subd. 1 is shown on the Revisor site as effective upon federal approval; whether approval has occurred was not verified. The statute text reviewed does not expressly address self-funded plans, and this section does not resolve whether ERISA applies to any particular plan.
