Getting a new technician started in Rhode Island
Rhode Island's rules read for this record do not require the BACB RBT for technicians, and an ABA aide may be trained on the job under a licensed ABA supervisor, so onboarding is largely driven by the employing agency's training plus BCI/CANTs screenings. The EOHHS standards are from 2016 and the licensing chapter was amended effective June 30, 2025, so confirm current requirements with EOHHS and the Department of Health. (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- Current EOHHS/Medicaid requirements for ABA technicians (the standards read are the 2016 edition) and the Medicaid provider enrollment URL/process.
- Whether the mandate's age 15 limit in 27-20.11-3 is current, given Neighborhood Health Plan's policy listing commercial ABA up to age 20.
- Which commercial and Medicaid plans currently dominate ABA in RI (only Neighborhood's policy was read in detail; UnitedHealthcare/Tufts names come from a 2017 fact sheet).
- What the June 30, 2025 amendments (P.L. 2025 ch. 323 and 324) changed in chapter 5-86 (including whether practice, not just title, is restricted and whether aide rules changed).
- RI Department of Health ABA license application page, processing time and renewal fee (the Department's page returned 403).
- Full meaning of 'BCI' and 'CANTs' screenings and who runs them.
- ABA-specific telehealth and telesupervision rules under RI Medicaid and commercial plans.
- Whether self-funded plans are subject to the mandate (not addressed by text read).
- medicaid_aba: verifier astra marked conflict - Coverage and EOHHS administration are supported. The broken fact-sheet URL has an accessible official relocated copy quoted here. Its two-year diagnosis condition conflicts with Neighborhood's current three-year condition; preserve the source distinction rather than announcing a statewide three-year rule. Current Neighborhood policy retains Medicaid enrollment, family/caregiver residence, significant challenges, and BCBA/licensed-professional oversight, but no longer enumerates MD/DO/NP/PA ordering credentials. The 2016 standards support ABA within HBTS, worker pathways and lead supervision; they remain linked with a June 8, 2021 addendum. Eight hours describes a historical allocation change, not a universal minimum: Appendix 11 lists 4–8 monthly hours and ABA may receive additional authorized support. BCBA certification alone should not be presented as replacing required RI licensure. Replace categorical rbt_required_for_technicians=no with 'not specified in the reviewed HBTS standards; payer-specific requirements not established.' Populate provider_enrollment_url with https://eohhs.ri.gov/providers-partners/provider-enrollment and include the current moratorium described under practice_requirements.
- bcba_licensure: verifier astra marked conflict - The licensing chapter, board, LBA/LABA terminology, protected titles, $150 statutory fee, and listed LBA qualifications are supported. Section 5-86-9(a) includes moral character, the specified graduate education/accreditation, acceptable coursework, supervised experience, BCBA examination, active BACB status, ethics, and practice limitations. Treat 1,500 hours as a statutory pathway, not a statement of present BACB certification requirements; §28.5.1 also allows board-acceptable BACB experience. The material conflict is psychologist equivalency: current §5-86-9(c) is deleted, while §5-86-2, §5-86-3 and the active regulation retain related language. Do not describe this as an uncomplicated current application route. Psychologists' separate authority to practice within their professional scope remains distinct. Replace '2025 amendments not reviewed' with this specific discrepancy; the June 30, 2025 enactment was opened and checked.
- practice_requirements: verifier astra marked conflict - Agency/center approval, evidence-based models, accreditation listing, screenings, training, and the dual-coverage payment sequence are supported by the 2016 text. Its transitional BCBA-certification language must not override current licensure requirements. Accreditation examples are not a mandatory accreditation requirement. Commercial-exhaustion payment applies to dual-covered individuals, not everyone. Add the June 2021 multi-agency coordination/billing addendum. Most importantly for current practice entry, EOHHS now posts a six-month moratorium on newly enrolling HBTS/ABA providers beginning June 16, 2026, covering the audit date. Certification eligibility therefore does not establish that a new practice can presently enroll and bill Medicaid. The notice limits its impact to newly enrolling providers.
