- Notes
Health insurance plans must cover evidence-based diagnosis and treatment of early childhood developmental disorders, including ABA supervised by a nationally board-certified behavior analyst. Applies to Medicaid and any other public health care assistance program. A major medical plan is not required to provide benefits exceeding the essential health benefits. Amount, frequency and duration are based on medical necessity and may require prior authorization; cost sharing may not exceed that for other conditions. Insurers may review treatment plans for children under 8 not more often than every six months, subject to an exception for inpatient treatment. Coverage must extend to services in the natural environment (a home or child care setting) furnished under the direct supervision of a licensed professional or, for ABA, under the supervision of a nationally board-certified behavior analyst. No numerical annual dollar cap appears in § 4082, but this does not establish that benefits are unlimited. Whether self-funded plans are excluded is unresolved; the cited sources do not establish a categorical exclusion.
