The autism coverage law in Washington
Washington mental-health parity statutes: RCW 48.20.580, RCW 48.21.241, RCW 48.44.341 and RCW 48.46.291 (effective until January 1, 2027); WAC 284-43-7080(2)-(3). RCW 48.43.766 takes effect January 1, 2027. See coverage details and sources.
Getting a new technician started in Washington
In Washington a new technician needs the state DOH Certified Behavior Technician credential (not just RBT) and a named clinical supervisor at application. An existing RBT can use that certification to qualify without the separate 40-hour DOH-defined training; otherwise the 40-hour training must be completed and applied within one year. HCA Medicaid enrollment also requires a core provider agreement. (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- Whether Washington has a state insurance mandate for autism/ABA coverage for commercial plans (none found in RCW 48.43/48.44/48.46; confirm with OIC).
- Background check or fingerprinting requirement for CBTs (not found in RCW 18.380 text read; employer, HCA or DSHS rules may apply).
- Exact HCA provider enrollment page URL (guide refers to an HCA Enroll as a provider webpage but gives no link) and the full list of HCA-contracted MCOs.
- Washington commercial telehealth parity law as applied to ABA.
- DOH processing time for CBT applications.
- Autism Speaks' December 2019 Washington page states that SB 5059 was enacted in 2014, but its linked official document is a Senate bill report dated January 25, 2011, not an enacted law. That enactment claim remains unverified and is not used as the statutory basis here. Existing mental-health parity statutes and regulations replace the prior section's assumption that coverage might depend on the 2027 law; ABA-specific scope and the no-cap summary retain medium confidence because their explicit support is secondary.
- medicaid_aba: verifier astra marked conflict - Replace the implication that every CBT needs an individual CPA: HCA requires individual servicing-provider enrollment, which may be under the group's CPA; the rendering provider's NPI must appear on claims. See the [HCA enrollment alert](https://content.govdelivery.com/accounts/WAHCA/bulletins/3e604aa). Change rbt_required_for_technicians to 'no': RBT is an optional qualifying route, while state CBT certification is required for enrollment as a CBT. Training must satisfy WAC 246-805-310, including experiential learning and competency assessment, not merely attendance at a 40-hour course. WAC 182-531A-0800(9)(a) and (11) also name licensed-psychologist supervision of a LABA. Its mental-health-professional route and BCBA/BCaBA attestation are present, although subsection (10) separately lists LBA/LABA for LBAT servicing enrollment; preserve that qualification rather than imply unrestricted eligibility. The weekly 5% minimum, equivalent to one hour per twenty hours, is supported. The day-program on-site requirement is supported by the HCA bulletin quoted under telehealth_aba. HCA's current listing supersedes the July 2025 guide with January 2026. Neither PDF yielded readable text despite alternate/archive attempts; historical attribution to the July PDF remains unverified.
- bt_vs_rbt: verifier astra marked conflict - Change 'within one year of completing' to 'complete training and submit the application within one year of starting the training program.' This directly conflicts with [WAC 246-805-310(7)](https://app.leg.wa.gov/wac/default.aspx?cite=246-805-310). Change the categorical unregistered_bt_may_deliver='no' to a qualified answer: state CBT certification is ordinarily required, but statutory exemptions and regulated trainee activity exist; absence of an RBT credential alone does not prohibit practice by a state-certified CBT. Age 18, high-school-equivalent education, alternative credential/training routes, supervisor identification, fees and biennial renewal are supported. Expand permitted evaluators/plan preparers to include professionals otherwise qualified under RCW 18.380.030(1), as WAC 246-805-320 expressly provides. The supervision agreement must precede behavior-analytic tasks, bear both signatures and be retained by both parties. Add the nonworking-renewal exception: a CBT attesting to not working must obtain the specified assessment within three months after obtaining CBT employment. Finally, Medicaid enrollment may be under a group's CPA; an individual CPA is not universally required.
- practice_requirements: verifier astra marked conflict - SUPPORTED: HCA approval, the signed HCA 13-0007 attestation on file, LBAT participation, applicable credentials for direct-service providers and the three-stage pathway. UNSUPPORTED in this audit: the exact 1:1 adult-to-child ratio and the assertions that students/trainees may be paid program staff only when meeting CBT requirements and otherwise their time is nonbillable. These details could not be verified because the cited billing guide and attempted alternatives were unreadable. 'No separate state agency license was identified' must remain an unknown, not an exemption: WAC 182-531A-0800(15)(a) expressly requires outpatient hospital facilities to meet chapter 246-320 WAC licensure requirements. Correct authorization to HCA or the applicable MCO process, and specify authorization before treatment-plan implementation rather than asserting every evaluation-stage service requires HCA authorization. See [WAC 182-531A-0600](https://app.leg.wa.gov/wac/default.aspx?cite=182-531A-0600) and [WAC 182-531A-0700](https://app.leg.wa.gov/wac/default.aspx?cite=182-531A-0700). Correct the universal individual-CPA assertion to reflect servicing enrollment under an organization's agreement. The null background-check field means unverified, not that no background-check requirements exist.
