ABA insurance and Medicaid coverage in Alaska

Last researched October 21, 2026

Who pays for ABA in Alaska, and what a practice has to do to bill them. Coverage details here come from statutes and agency pages we read, not from payer marketing.

Autism insurance mandate

Medium confidence: reputable secondary source
State mandate for autism coverage

Yes, the research found a state autism coverage law.

Statute

AS 21.42.397 (Coverage for autism spectrum disorders)

Age limits

As of 2026-10-21, the statute requires coverage for individuals under 21 years of age (AS 21.42.397(b)(1)). This should not be read as the only operative limit: the Alaska Division of Insurance's May 21, 2026 guidance for plan year 2027 warns against discriminatory age limits under ACA requirements.

Annual cap

The statute states no dollar or hour cap, and it prohibits limiting the number of visits to an autism service provider (AS 21.42.397(b)(2)). That protection concerns visits. It is not an unconditional entitlement to unlimited hours, and coverage is subject to medical necessity and the treatment-plan requirement.

Excludes self-funded employer plans

It depends.

Notes

Applies to 'health care insurers' offering health care insurance plans in Alaska (except fraternal benefit societies). Covered care includes applied behavior analysis as habilitative/rehabilitative care, when medically necessary and prescribed by a licensed physician, psychologist or APRN, and provided or supervised by an 'autism service provider' (an individual licensed, certified or registered by a state board or nationally recognized certifying organization). Care must follow a treatment plan developed following a comprehensive evaluation (per Division of Insurance Bulletin B15-05). Subject to normal copay/deductible/coinsurance. Small employers in the group market with 20 or fewer employees are not required to include the coverage; the director may waive it for employers with 21-25 employees, but only on actual claims experience over a consecutive 12-month period showing premium growth of at least 3% attributable to compliance. The Division's group checklist expressly qualifies the small-group exclusion, so it should not be treated as a blanket exemption. The statute text does not expressly address self-funded (ERISA) plans; such plans are generally excluded from state insurance mandates, but this depends on the plan type, so confirm for the specific plan.
