ABA insurance and Medicaid coverage in Arkansas
Last researched October 21, 2026
Who pays for ABA in Arkansas, and what a practice has to do to bill them. Coverage details here come from statutes and agency pages we read, not from payer marketing.
Autism insurance mandate
- State mandate for autism coverage
Yes, the research found a state autism coverage law.
- Statute
Ark. Code Ann. § 23-99-418 (2025 codification reproduced by Justia); history lists Act 196 of 2011 and Act 656 of 2021.
- Age limits
Subsection (c)(2) specifies children under 18 for ABA. Actual coverage may extend beyond this statutory wording: Arkansas Blue Cross and Blue Shield policy 2011053, effective October 1, 2026, reports that the Arkansas Insurance Department disallows autism-treatment age limits for fully insured, metallic and state/public-school employee contracts.
- Annual cap
Subsection (c)(1) specifies $50,000 annually for ABA; subsection (d)(1) prohibits visit limits and less-favorable dollar limits, deductibles or coinsurance than for physical illness. Autism Speaks cautions that mental-health parity can preclude age and dollar caps. Arkansas Blue Cross's policy effective October 1, 2026 lists $50,000 for grandfathered plans and policy/coding limits for non-grandfathered plans. The previously recorded 1,300/520-hour limits are not in the fetched statute.
- Excludes self-funded employer plans
Yes, self-funded employer plans are generally outside state mandates.
- Notes
As of 2026-10-21, the fetched statutory text covers state-regulated group/blanket plans, expressly including state/public-school employee plans, while excluding individual major medical and specified limited-benefit plans. Coverage applies to policies issued, changed or renewed from October 1, 2011. From January 1, 2014, subsection (i) exempts Exchange benefits exceeding essential health benefits; it does not categorically exclude all Exchange autism coverage. Autism Speaks separately identifies ACA-compliant individual plans as covered. The self-funded exclusion above refers generally to private-sector ERISA plans, consistent with U.S. Department of Labor guidance dated November 6, 2014, and does not exclude the government employee plans expressly included by Arkansas law. The statute requires ABA provided or supervised by a BACB-certified behavior analyst; it specifies neither RBT certification nor independent technician billing rights. Arkansas Blue Cross's policy requires direct-line therapy to follow applicable state law and, absent such law, be delivered by an RBT, BCaBA or master's/doctoral BCBA. This insurer-specific requirement does not establish eligibility under every commercial plan. Confidence is medium because the statute was read through Justia and the statewide interpretation of age limits was obtained through insurer/advocacy sources rather than an opened AID directive.
