Practice requirements for ABA providers in North Carolina
Last researched October 21, 2026
The internal processes a practice in North Carolina has to run before and after a technician starts. A practice, not MeetAllo, remains responsible for compliance.
Requirements for practices
- Facility or agency license
Conditional on the operation and setting. As of 2026-10-21, NC DHSR explains that G.S. 122C-3(14)b covers facilities whose primary purpose is mental-health, developmental-disability or substance-use treatment and that serve at least one minor or two adults for day services lasting at least three hours per individual in a 24-hour period, or residential services lasting at least 24 consecutive hours. Such facilities require licensure unless an exclusion applies. G.S. 122C-22(a)(1) excludes physicians and psychologists engaged in private office practice; it does not expressly name behavior analysts in that exclusion. These sources do not establish that every ABA practice requires a facility license or that every ABA practice is exempt; applicability to a particular clinic or home-service agency remains setting-specific.
- Background checks
G.S. 122C-80 requires covered Chapter 122C licensed providers hiring for positions without an occupational-license requirement to obtain consent for criminal-history screening. Applicants resident in NC for less than five years require state and national checks, including fingerprints for the national check; those resident for at least five years require a state check. Requests generally must be submitted within five business days of the conditional offer; subsection (g) separately addresses conditional employment. This is a setting-specific requirement relevant to BT hiring, not a universal rule established for every ABA employer. Separately, G.S. 90-744 requires analyst-licensure applicants to consent to criminal-history checks and provide fingerprints. The BACB RBT Handbook fetched on 2026-10-21, updated June 2026, requires criminal-background and abuse-registry checks within 180 days before application payment, subject to its stated registry-availability exceptions; BACB itself does not require fingerprinting.
- Staff training
CCP 8F, amended Aug 1, 2026, section 6.1 requires paraprofessionals to complete competency-based ASD/RB-BHT training equivalent to BACB technician minimum training hours; section 6.2 requires documented competencies and supervision. For RBT applicants, the fetched BACB Handbook requires 40 hours of qualifying training completed over 5-180 days, an initial competency assessment after training and within 90 days before application, and passing the certification examination. These are RBT-route requirements, not verified ABAT training requirements. DHSR states that all staff in facilities it regulates must be trained and competent for the clients served. Blue Cross NC's commercial ABT policy, reviewed June 2026 with changes effective Sep 9, 2026, permits an alternative to BACB certification for eligible NC paraprofessionals: supervisor-attested confidentiality, mandated-reporting and professional-ethics training, ASD/treatment instruction, demonstrated treatment-technique mastery, and documented ongoing supervision. The policy permits documented supervisor explanations for why ASD/treatment instruction or pre-client mastery was unnecessary.
- Other requirements
As of 2026-10-21, behavior-analyst practice is regulated by the North Carolina Behavior Analyst Licensure Board under Chapter 90, Article 43. G.S. 90-745(2) exempts BTs working under the authority and direction of an appropriately licensed professional within that professional's scope and competence; BTs implement assigned services and cannot design assessment or intervention plans. This exemption does not itself specify RBT certification. Medicaid reimbursement is separate: the Aug 31, 2026 bulletin permits uncertified paraprofessional services during the applicable 120-day grace period with LQASP supervision, but denies reimbursement after that period without RBT or ABAT certification. CCP 8F section 6.0 separately requires billing providers to meet Medicaid participation qualifications and have a signed DHHS participation agreement. Blue Cross NC's cited commercial policy allows unlicensed paraprofessionals aged at least 18 through either its BACB-certification route or the training/competency alternative described above, with supervision by professions numbered 1-7 in its NC provider list. Benefits and reimbursement remain plan-specific; the policy does not establish independent BT billing eligibility. For electronic services, the Board applies the same legal and ethical obligations regardless of modality and treats practice as occurring at both provider and client locations. The BACB Handbook permits qualifying live video supervision, subject to applicable law. Medicaid's removal of telehealth for 97152-97154 remains distinct from supervisor services: CCP 8F Attachment A permits telehealth for 97155, ordinarily limited to 50% of that code's billing per beneficiary per 180 days, and requires treatment-plan clinical justification for additional telehealth units. Incidental supervision and staff training are not separately reimbursable. General information, not legal advice.

Medicaid supervision and enrollment

- Supervision requirements
Paraprofessionals work under LQASP or C-QP supervision. The bulletin states that at least 10% of all RB-BHT services provided by a paraprofessional must involve observation and direction, and this observation specifically requires an LQASP. Service-hour ratios apply based on each beneficiary's accumulated paraprofessional services (not one technician's total workload); CCP 8F uses more than 200 hours in 180 calendar days. The LQASP assumes professional responsibility. Incidental supervision or training is not independently reimbursable.

National baseline for onboarding a technician
Items below are supported by BACB or regulator sources. Your state may add more.
- Verify RBT status on the BACB Certificant Registry (status, expiration, listed supervisor; red text means may not practice) or via portal verification report / $25 written verification.
- Ensure a qualified BCBA/BCaBA supervisor (with completed supervisor training 2.0) or RBT Requirements Coordinator lists the RBT as supervisee in their BACB portal before the RBT provides services as an RBT.
- Assign a supervisor/Coordinator for every client the RBT serves; no relation, employer-superior or multiple relationship with the RBT.
- Plan supervision: 5% of monthly service hours, at least two real-time contacts per month, one individual, one observation of services; document dates, durations, format, observations; retain 7 years.
- Criminal background check and abuse registry check comparable to those for home health aides/child care/teachers, within 180 days before the application is paid; fingerprinting may be required by state or organization.
- For applicants: have a BCBA/BCaBA Responsible Assessor (with 8-hour supervision training, same organization as applicant and clients, not related/subordinate/employed by the applicant at the time of assessment) complete the ICA after the 40-hour training; keep assessment records 7 years.
- Attesting Certificant for the application attestation must not be related to, subordinate to, or employed by the applicant.
- Correct worker classification (employee vs contractor) for RBTs; BACB may ask for a tax professional's written opinion in an ethics matter.
- For TRICARE ACD enrollment: RBT/ABAT/BCAT or state certification, current BLS/CPR, authorized ABA supervisor named, 10-year federal/state/county criminal and sex-offender history check.
- For Medicaid/commercial payers: confirm state Medicaid or payer definition of technician qualifications, enrollment and credentialing before billing (state-specific).
Verify any certified technician on the BACB certificant registry.
