Practice requirements for ABA providers in Nebraska

Last researched October 21, 2026

The internal processes a practice in Nebraska has to run before and after a technician starts. A practice, not MeetAllo, remains responsible for compliance.

Requirements for practices

Medium confidence: reputable secondary source
Facility or agency license

Background checks

Registry checks are verified for LBA/LaBA applications only. This should not be read as a background-check requirement for every employee. As of 2026-10-21, no broader background-check rule was confirmed.

Staff training

Medicaid: licensed and non-licensed staff must work within scope and have training in rehabilitation, recovery principles and trauma-informed care. The ABA service definition requires the treatment plan to be reviewed and updated at least every 90 days, and caregiver participation. Caregiver participation is currently 1 hour/month for recipients receiving at most 10 monthly ABA hours and 2-4 hours/month for those receiving more, with documented exceptions. The continued-stay paragraph separately retains a blanket 2-4-hour statement. Providers must provide access to 24/7 crisis services, which may be met through qualifying outside crisis resources. An agency need not operate its own 24/7 service. Verify current text against the DHHS ABA service definition.

Other requirements

As of 2026-10-21: the current ABA service definition requires initial prior authorization materials. It sets ordinary limits of 6 hours/day and 20 hours/week, and additional hours require approved clinical justification. Hours within the limits should not be assumed to need no authorization. WOWT (July 2026) described a change in the weekly hours allowed before prior authorization from 30 to 20. Published rates include $18.70 for CPT 97153 and $22.72 for CPT 97155. These rates are code-specific and do not apply to all RBT or BCBA work. WOWT reports DHHS adjusted rates 'last year', so the rate cuts should not be dated to July 2026. Whether these rates match the current fee schedule is unconfirmed, because the revised SFY27 fee schedule file could not be read.

Supervision requirements

RBT services under direction of an LBA or ABA-trained psychologist; LaBAs require an LBA. Direct supervision by observation must be at least 10% of direct service hours (97153/97154/97155) per week, documented, with a corrective action plan when missed; supervisor must observe the technician or LaBA in person at least one hour per month; treating LBA/psychologist must provide at least one hour of in-person direct service to the individual at least monthly. An LBA may not supervise more than 24 technicians. Staffing ratios: 97153 1 technician:1 child; 97154 1 technician:2-5 children.

National baseline for onboarding a technician

Items below are supported by BACB or regulator sources. Your state may add more.

  • Verify RBT status on the BACB Certificant Registry (status, expiration, listed supervisor; red text means may not practice) or via portal verification report / $25 written verification.
  • Ensure a qualified BCBA/BCaBA supervisor (with completed supervisor training 2.0) or RBT Requirements Coordinator lists the RBT as supervisee in their BACB portal before the RBT provides services as an RBT.
  • Assign a supervisor/Coordinator for every client the RBT serves; no relation, employer-superior or multiple relationship with the RBT.
  • Plan supervision: 5% of monthly service hours, at least two real-time contacts per month, one individual, one observation of services; document dates, durations, format, observations; retain 7 years.
  • Criminal background check and abuse registry check comparable to those for home health aides/child care/teachers, within 180 days before the application is paid; fingerprinting may be required by state or organization.
  • For applicants: have a BCBA/BCaBA Responsible Assessor (with 8-hour supervision training, same organization as applicant and clients, not related/subordinate/employed by the applicant at the time of assessment) complete the ICA after the 40-hour training; keep assessment records 7 years.
  • Attesting Certificant for the application attestation must not be related to, subordinate to, or employed by the applicant.
  • Correct worker classification (employee vs contractor) for RBTs; BACB may ask for a tax professional's written opinion in an ethics matter.
  • For TRICARE ACD enrollment: RBT/ABAT/BCAT or state certification, current BLS/CPR, authorized ABA supervisor named, 10-year federal/state/county criminal and sex-offender history check.
  • For Medicaid/commercial payers: confirm state Medicaid or payer definition of technician qualifications, enrollment and credentialing before billing (state-specific).

Verify any certified technician on the BACB certificant registry.
