Getting a new technician started in New York
In New York a new technician does not need the BACB RBT credential or any state registration to work under an LBA in Medicaid ABA, so onboarding speed depends mainly on the employer (training, supervision capacity, and any employer or managed-care RBT requirement). Supervising LBAs face a 6-person cap and monthly supervision rules, so openings depend on LBA capacity. (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- Actual statutory text of Insurance Law 3216(i)(25), 3221(l)(17) and 4303(ee): age limits, dollar/visit limits, ABA provider-qualification wording and self-funded plan treatment. Only NCSL's summary was read.
- Whether NY Medicaid FFS and managed care plans allow direct 1:1 ABA by technicians via telehealth, and applicable modifiers (NYS Medicaid telehealth policy page returned 403).
- Whether individual NY Medicaid managed care plans or commercial payers require the BACB RBT credential for technicians.
- Employer-level background check, fingerprinting, CPR or TB requirements for technicians (none found in the sources read).
- Full list of NY Medicaid managed care plans covering ABA since the Jan 1, 2023 carve-in; only MetroPlus was sourced.
- NYS regulation on supervision of unlicensed individuals under Part 79 and Education Law 8807 beyond what the Medicaid manual states.
- medicaid_aba: verifier astra marked conflict - Correct 'Only enrolled LBAs bill': Article 28 facilities may also bill. Individual FFS billing runs through an enrolled LBA; CBAAs enroll as OPRA and do not bill independently. CBAAs are NYSED-certified. The 5% denominator is ABA-service hours, not all work hours. Manual §§5–9 support DSM-5 ASD/Rett eligibility; referrals from NY-licensed, Medicaid-enrolled physicians, psychologists, psychiatric NPs, pediatric NPs or PAs; school-setting exclusion; observation during one monthly contact; one optional small-group contact; and six-month review rules. For 97155 to count, the LBA must join the patient and technician to direct the new/modified protocol. RBT absence supports 'not specified in this manual'; employer/MCO requirements remain unverified.
- bcba_licensure: verifier astra marked conflict - The supplied fees, two pathways, training, age, character, and effective-date statements are supported by the current requirements page and statutes. However, cited FAQ 15 still rejects BACB-based qualification and discusses the expired 2014–2016 pathway; it conflicts with current §8805 and the requirements page. Identify that FAQ as stale. Pathway Two requires BCBA certification, not merely any BACB credential. Distinguish the LBA license from CBAA certification. Qualify the graduate-permit statement to graduates of acceptable programs performing the described activities in NY; §8807 separately exempts qualifying supervised students/interns. Licensure requirements also have statutory exemptions.
- practice_requirements: verifier astra marked conflict - Replace the universal five-year revalidation statement: current DOH guidance uses three-, four-, or five-year cycles by risk tier, requires revalidation when requested, and uses the Provider Services Portal. Do not assume an ABA provider's risk tier without its notice. The older ABA manual still says five years. The legally authorized-setting and Article 28 OPRA/affiliation requirements are supported. Retain records for at least six years and, for minors, through age 22, satisfying both periods. The listed referral professions and school exclusion describe this Medicaid benefit, not every lawful ABA setting or prescription. Separate agency licensure and general technician background-check rules remain unverified; null must not mean none. Absence of a specified technician training credential does not remove the LBA's responsibility to train and supervise staff.
