- Notes
As of 2026-10-21, NCSL summarizes that N.Y. Insurance Law 3216, 3221 and 4303 address coverage of autism spectrum disorder, and it defines treatment to include behavioral health treatments, psychiatric care, psychological care, medical care, therapeutic care and specified pharmacy care. The checker retrieved the current statute text and found the provisions work differently by policy type. Section 3216 (hospital/surgical policies) provides that such policies 'shall not exclude coverage for screening, diagnosis and treatment of medical conditions otherwise covered by the policy', which is a nondiscrimination protection for otherwise-covered conditions rather than a standalone autism coverage mandate. Section 3221 (comprehensive policies) requires coverage that will 'provide coverage for the screening, diagnosis and treatment of autism spectrum disorder', and the current text expressly addresses applied behavior analysis (ABA) and provider qualifications (e.g., providers 'licensed, certified or otherwise authorized'). Section 4303 provides that contracts 'shall not contain any limitations on visits that are solely applied to the treatment of autism spectrum disorder'. DFS describes individual and small-group ABA coverage as unlimited, but NCSL alone does not establish a dollar or visit cap, so annual_cap is left null (unverified). No explicit statement about age limits was located, so age_limits null means unverified, not confirmed unrestricted coverage. Self-funded ERISA plans are outside this state insurance mandate; this qualification should not be generalized to every governmental or other non-ERISA self-funded plan, so the self-funded-plan answer is conditional. NCSL's page carries an 'Updated August 24, 2021' stamp for its mandate summaries.
