The autism coverage law in Oklahoma

Getting a new technician started in Oklahoma
A new Oklahoma BT who wants Medicaid-billable work should plan on completing BACB RBT certification and then being contracted with SoonerCare through the OHCA provider portal; the supervising BCBA must also be SoonerCare-contracted. The BCBA licensing authority is changing to the State Board of Examiners of Psychologists on Nov 1, 2026, which may briefly affect supervisor license verification and renewals. (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- Whether HB 2962 (36 O.S. 6060.21) has been amended since 2016, and the current inflation-adjusted annual ABA cap.
- Whether the mandate applies to self-funded plans (statute text read does not address it; ERISA treatment needs counsel).
- Whether SoonerSelect health plans (Aetna Better Health of Oklahoma, Humana Healthy Horizons of Oklahoma) impose additional ABA credentialing or RBT enrollment steps; only Oklahoma Complete Health's page was opened.
- Whether uncertified technicians have any grace window under SoonerCare or commercial plans.
- Oklahoma commercial telehealth parity law as it applies to ABA, and whether supervision may be delivered by telehealth under SoonerCare.
- Background check/fingerprint requirements for RBTs under SoonerCare or employing agencies.
- Exact BCBA license fee and application steps after the Nov 1, 2026 transfer to the State Board of Examiners of Psychologists.
- Whether any Oklahoma facility/agency license is required to operate an ABA clinic.
- autism_insurance_mandate: verifier astra marked conflict - Replace the historical summary with current 36 O.S. § 6060.21. HB 2962 created the mandate; its November 1, 2016 plan trigger, under-nine/after-three/six-year provisions, progress condition, caps and inflation mechanism are accurately described historically. SB 1240 § 8, effective November 1, 2022, deleted those age/progress restrictions, the 25-hour/$25,000 caps and inflation mechanism, and former subsection I's exclusions. There is consequently no current inflation-adjusted cap under this section to verify. Current coverage incorporates § 6060.11 parity requirements. Subsection E includes services provided OR supervised by a BCBA, BCaBA or licensed doctoral-level psychologist. Annual treatment-plan review excludes inpatient services; more frequent review requires an individual agreement, and the insurer pays review costs. Assess limited-benefit exclusions through the incorporated § 6060.4(C) definition rather than deleted subsection I. The cited bill alone does not resolve ERISA preemption; retain the self-funded field as unverified rather than implying universal applicability.
- bcba_licensure: verifier astra marked conflict - The $100 statement misreads struck-out text: SB 1557 deletes that ceiling and authorizes reasonable issuance/renewal fees sufficient to cover board costs. The existing ceiling remains relevant on October 21, 2026; the amendment takes effect November 1. DHS/DDS remains the current statutory authority on the audit date. Replace 'imminent or just occurring' with a definite future transition; the about page's past tense conflicts with its future effective date and the homepage notice. The license/certification titles, BACB qualification, minimum age, renewal deadline and forthcoming national criminal-history check are supported. BCBA and BCaBA are national credentials; Oklahoma separately licenses behavior analysts and certifies assistants. The human-services exception additionally requires ABA to match the professional's training and experience. The practice restriction also has supervisee and other statutory exceptions.
- bt_vs_rbt: verifier astra marked conflict - The Medicaid RBT-certification, individual OHCA-contract, residence, overpayment and exclusion statements are supported by § 311. An uncertified technician does not satisfy its RBT provider category; these sources establish no grace period. State practice permission and payer reimbursement must be separated: the supervisee provision already operates under current § 1928(E)(1), rather than first arising under SB 1557. Correct the commercial-law description to current § 6060.21(E), which includes services provided or supervised by BCBAs, BCaBAs and licensed doctoral-level psychologists. The claim that commercial technician credentialing is simply left to payers is unsupported by the cited statute alone; individual payer requirements were not established.
