The autism coverage law in Oregon
Oregon Laws 2013, chapter 771, section 2 (compiled as a note following ORS 743A.264, 'Temporary provisions relating to coverage of applied behavior analysis'); related general coverage in ORS 743A.190. Note: ORS 743A.325 is NOT the autism statute (it covers gender-affirming treatment). See coverage details and sources.
Getting a new technician started in Oregon
Oregon requires state registration (BI) instead of, or in addition to, the BACB RBT for technicians; the statute's 5-business-day provisional registration after a complete application is the main speed feature found, but the applicant still needs 40 hours of training and a completed fingerprint background check first. Rule text on the OregonLaws mirror was last accessed May 2025 per its footer; confirm against the Secretary of State site before relying on it. (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- Whether unregistered individuals may legally deliver ABA in Oregon, and whether BI registration is mandatory for technicians working for a licensed provider.
- Whether OHP coordinated care organizations require RBT in addition to BI registration, and which CCOs/commercial payers dominate ABA (no payer list was sourced).
- OHP provider enrollment URL for ABA/behavioral health providers.
- Whether the BI registration rules or fees changed after the 2023 amendments to ORS 676.815 (2023 c.394, c.500) and whether the OAR text on the mirror is current.
- Whether the ABA mandate (sunset January 2, 2030) applies to self-funded plans.
- Whether ABA delivered by telemedicine is covered by commercial plans despite the statute's exclusion list wording.
- Any facility or agency licensing requirement for ABA clinics.
- medicaid_aba: verifier astra marked conflict - The billing categories, assessment requirements and referral structure are substantially supported. Replace 'physician assistant' with the current rule's 'physician’s associate'; developmental-medicine specialization applies to the nurse practitioner and physician associate. Flag the registration language: OAR 410-172-0760(3)(b) still references registration with an 'Oregon Behavior Analyst Certification Board,' while ORS 676.802 merely defines eligible licensed professions and does not establish that registration process. Do not present this inconsistency as a verified enrollment instruction. Replace the categorical rbt_required_for_technicians='no' with 'RBT not specified in the reviewed statewide provisions; CCO requirements unverified.' Absence of RBT wording is not affirmative proof that every payer dispenses with it. The provider-enrollment URL can be populated with https://www.oregon.gov/oha/HSD/OHP/Pages/Provider-Enroll.aspx.
- bcba_licensure: verifier astra marked conflict - Replace the mirror with the official OAR. Effective February 1, 2023, OAR 824-030-0010 requires BACB documentation showing satisfaction of its January 1, 2022 requirements for applicants certified on or after that date; earlier-certified applicants must show satisfaction of requirements applicable when certified. The current rule does not retain the mirror's blanket 'or equivalent' wording. The listed application-plus-license/registration totals are supported: $350, $300 and $175, respectively; do not characterize them as including every possible ancillary cost. Qualify state_license_required: BCBA certification alone does not establish Oregon authorization, but the cited provisions also recognize other licensed health professionals and legacy declarants.
