Practice requirements for ABA providers in Utah

Last researched October 21, 2026

The internal processes a practice in Utah has to run before and after a technician starts. A practice, not MeetAllo, remains responsible for compliance.

Requirements for practices

Facility or agency license

Utah Code 26B-2-105 requires human-services program licensure, subject to 26B-2-115 exclusions. Under 26B-2-101(14), ABA meeting the day-treatment criteria (including four or more clients unrelated to the owner or provider, served individually or in groups during any 30-day period, for less than 24 hours/day, with specified impairments) is presumed day treatment unless the provider demonstrates to the Office of Licensing that it qualifies as outpatient treatment. Both categories are human-services programs. The fetched code incorporates 2026 amendments; outpatient classification does not itself establish a licensing exemption.

Background checks

For applicants associated with a DHHS certification, contract or licensee who have direct access to children or vulnerable adults, 26B-2-120 requires background screening, subject to statutory exceptions. Adult applicants submit fingerprints; screening includes criminal and specified noncriminal records, with ongoing monitoring. A denied applicant cannot have direct access unless subsequently approved. This describes the version applicable on 2026-10-21, marked superseded January 1, 2027; it does not establish a universal screening requirement for every independently enrolled BT.

Staff training

For programs subject to human-services licensure, R501-1-16 requires preservice training before staff are left unsupervised and within 30 days of hire, plus annual training. Topics include CPR/first aid, emergency procedures, client rights, abuse/neglect reporting, code of conduct and applicable program practices. This summary is supported by a legislature-hosted rule copy and Cornell's version, which lists December 19, 2023 as its latest effective change; current official rule HTML was unavailable. Separately, Utah Medicaid's January 2026 ASD manual requires full approved technician certification before services, with no hiring grace period; certifying organizations set certification criteria.

Other requirements

Medicaid-enrolled providers must follow their provider enrollment agreement and practice within their license and training scope. Enrollment is online through PRISM with a Utah ID, and current technician certification must accompany enrollment. R414-23-3 permits reimbursement only for services rendered during an enrollment period and requires revalidation at intervals not exceeding five years, depending on risk level. The rule page identifies November 10, 2023 as its effective date and September 16, 2024 as its continuation date. These enrollment rules do not authorize services by an uncertified technician or establish commercial-payer credentialing requirements. General information, not legal advice.

Supervision requirements

QHP must supervise a minimum of 10 percent of the time the member receives direct services from a technician or assistant behavior analyst; at least 50 percent of that supervision must be direct. An additional 10 percent direct supervision may be requested via prior authorization when medically necessary. QHP must observe the technician implementing the plan.

National baseline for onboarding a technician

Items below are supported by BACB or regulator sources. Your state may add more.

  • Verify RBT status on the BACB Certificant Registry (status, expiration, listed supervisor; red text means may not practice) or via portal verification report / $25 written verification.
  • Ensure a qualified BCBA/BCaBA supervisor (with completed supervisor training 2.0) or RBT Requirements Coordinator lists the RBT as supervisee in their BACB portal before the RBT provides services as an RBT.
  • Assign a supervisor/Coordinator for every client the RBT serves; no relation, employer-superior or multiple relationship with the RBT.
  • Plan supervision: 5% of monthly service hours, at least two real-time contacts per month, one individual, one observation of services; document dates, durations, format, observations; retain 7 years.
  • Criminal background check and abuse registry check comparable to those for home health aides/child care/teachers, within 180 days before the application is paid; fingerprinting may be required by state or organization.
  • For applicants: have a BCBA/BCaBA Responsible Assessor (with 8-hour supervision training, same organization as applicant and clients, not related/subordinate/employed by the applicant at the time of assessment) complete the ICA after the 40-hour training; keep assessment records 7 years.
  • Attesting Certificant for the application attestation must not be related to, subordinate to, or employed by the applicant.
  • Correct worker classification (employee vs contractor) for RBTs; BACB may ask for a tax professional's written opinion in an ethics matter.
  • For TRICARE ACD enrollment: RBT/ABAT/BCAT or state certification, current BLS/CPR, authorized ABA supervisor named, 10-year federal/state/county criminal and sex-offender history check.
  • For Medicaid/commercial payers: confirm state Medicaid or payer definition of technician qualifications, enrollment and credentialing before billing (state-specific).

Verify any certified technician on the BACB certificant registry.
