The autism coverage law in Maine
24-A M.R.S. §2768 (individual policies and contracts), §2847-T (group policies, contracts, and certificates), and §4259 (individual and group HMO contracts). 24 M.R.S. §2317-B(12-H) makes those three sections applicable to nonprofit hospital and medical service organizations and health care plans licensed under Title 24. Enacted by P.L. 2009, c. 635 (LD 1198), signed April 12, 2010; age limit amended by P.L. 2013, c. 597 (LD 347). Revisor text extracted 10/05/2026; section histories end at P.L. 2013, c. 597. Getting a new technician started in Maine
In Maine a new technician holding a current RBT credential can deliver MaineCare Section 28 ABA from the date of hire (subject to the pending-SPA caveat), while someone without RBT must be in BHP training within 30 days and certified within 6 months under the 2026 rule. Employers also have to be a licensed behavioral health organization, so individual practices cannot simply enroll as a BCBA group. (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- Whether CMS has approved the State Plan Amendment behind the starred staff-qualification provisions in Section 28 (RBT-at-hire or BHP within 6 months).
- Whether Maine licenses behavior analysts (only a secondary source read; OPOR directory not conclusive).
- Individual-policy autism insurance statute (only the group-policy 2847-T section was read) and whether self-funded plans are excluded.
- Whether the BHP course prerequisites (CPR/First Aid, Bloodborne Pathogens, CPI background check) remain in effect in 2026; source is 2021 testimony.
- MaineCare Chapter I Section 4 telehealth rule text and any commercial telehealth parity law.
- Commercial payers active in Maine for ABA.
- Whether BHP certification can be skipped entirely by an RBT who changes employers.
- medicaid_aba: verifier astra marked conflict - CONFLICT: program_name is outdated. The [April adoption notice](https://www3.maine.gov/dhhs/about/rulemaking/mainecare-notice-agency-rulemaking-adoption-mainecare-benefits-manual-chapter-ii-section-28-2026-04-27) expressly replaces the former rule with Adaptive Behavior Services for Children. Coverage, agency, enrollment resource and general under-21 scope are supported. The December 2024 bulletin supports its historical BHP/BCBA staffing, agency enrollment/licensing and bundled supervisor-cost statements; it cannot establish the replacement rule's current staffing requirements. UNSUPPORTED in this audit: filing 2026-101; age-18/diploma/registry requirements; BHP-versus-RBT alternatives and hiring deadlines; licensed-psychologist qualifications; Level 2+ and its school exception; 20-hour threshold, four-hour supervision minimum and prorated one-hour minimum; supervisor assessment/ITP duties; and the exact CMS asterisk language or approval status. The cited DOCX, alternative official adopted PDF and attempted archive were inaccessible. The January emergency notice says Level 3+, but predates the replacement; it does not establish the October threshold. Downgrade high confidence and leave these detailed current-rule claims unverified.
- practice_requirements: verifier astra marked conflict - CONFLICT: change 'needed this license by November 1, 2024' to 'had to apply by November 1, 2024.' The [licensing bulletin](https://content.govdelivery.com/accounts/MEHHS/bulletins/3b60e14) supports Chapter 123 licensing and exemptions for DOE-operated public schools, special-purpose private schools and state independent educational units/CDS, plus OCFS-licensed childcare facilities. It expressly distinguishes CBHS program approval from OCFS childcare licensure. Use the precise mental-health license terminology. UNSUPPORTED as verified replacement-rule requirements: the exact OBH approval/current-license provision; Chapter 128 registry restriction; BHP/RBT staffing alternatives; §§28.08-1 through 28.08-3 assessment, ITP, authorization and utilization-review requirements; and the categorical statement that billing is only for direct-care staff time. The 2024 BCBA bulletin supports non-separate supervisor billing, which alone does not prove that broader billing claim. The inaccessible rule also prevents verifying the assertion that it contains no other background-check provisions. Downgrade high confidence.
