Practice requirements for ABA providers in Maine
Last researched October 21, 2026
The internal processes a practice in Maine has to run before and after a technician starts. A practice, not MeetAllo, remains responsible for compliance.
Requirements for practices
- Facility or agency license
As of 2026-10-21, community providers are described as needing to be MaineCare-enrolled and to hold a mental health license under 10-144 CMR ch. 123 (Behavioral Health Organizations Licensing Rule). A DHHS bulletin (govdelivery) said Section 28 providers had to apply for a Mental Health Organization License by November 1, 2024. The bulletin exempts providers operated under Department of Education authority (DOE-operated public schools, special-purpose private schools, and state independent educational units/CDS) and OCFS-licensed childcare facilities from obtaining a mental health license through DLC. The bulletin distinguishes CBHS program approval from OCFS childcare licensure. A Behavioral Health Organization can hold a mental health license, a substance use disorder treatment license, or both. The exact Office of Behavioral Health approval and current-license provision in the replacement rule could not be verified; the OBH page says providers must contact a Resource Coordinator to begin the CBHS application process.
- Background checks
Not verified. The Chapter 128 CNA and Direct Care Worker Registry restriction could not be confirmed as a requirement of the replacement rule, and the rule text was inaccessible, so it is unknown whether it contains other background-check provisions.
- Staff training
Not verified. BHP and RBT staffing alternatives for staff delivering ABA could not be confirmed against the replacement rule text.
- Other requirements
Not verified. The prior authorization and utilization review, comprehensive assessment, and ITP requirements (cited as rule sections 28.08-1 to 28.08-3) and the statement that billing is only for direct care staff time could not be confirmed. A 2024 BCBA bulletin supports non-separate supervisor billing, which alone does not establish the broader billing claim.
Medicaid supervision and enrollment
- Provider enrollment
- https://www.maine.gov/dhhs/oms/providers/provider-enrollment-revalidation
- Supervision requirements
Not verified for the replacement rule. The Dec 2024 bulletin supports only that, under the prior framework, ABA/Specialized Services were delivered by BHPs with a supervising BCBA and that supervisor cost is bundled into the provider's reimbursement. The previously stated hour thresholds (20+ direct hours, 4 hours/month, prorated 1-hour minimum) and supervisor assessment/ITP duties are unconfirmed and should be checked against the adopted rule.

National baseline for onboarding a technician
Items below are supported by BACB or regulator sources. Your state may add more.
- Verify RBT status on the BACB Certificant Registry (status, expiration, listed supervisor; red text means may not practice) or via portal verification report / $25 written verification.
- Ensure a qualified BCBA/BCaBA supervisor (with completed supervisor training 2.0) or RBT Requirements Coordinator lists the RBT as supervisee in their BACB portal before the RBT provides services as an RBT.
- Assign a supervisor/Coordinator for every client the RBT serves; no relation, employer-superior or multiple relationship with the RBT.
- Plan supervision: 5% of monthly service hours, at least two real-time contacts per month, one individual, one observation of services; document dates, durations, format, observations; retain 7 years.
- Criminal background check and abuse registry check comparable to those for home health aides/child care/teachers, within 180 days before the application is paid; fingerprinting may be required by state or organization.
- For applicants: have a BCBA/BCaBA Responsible Assessor (with 8-hour supervision training, same organization as applicant and clients, not related/subordinate/employed by the applicant at the time of assessment) complete the ICA after the 40-hour training; keep assessment records 7 years.
- Attesting Certificant for the application attestation must not be related to, subordinate to, or employed by the applicant.
- Correct worker classification (employee vs contractor) for RBTs; BACB may ask for a tax professional's written opinion in an ethics matter.
- For TRICARE ACD enrollment: RBT/ABAT/BCAT or state certification, current BLS/CPR, authorized ABA supervisor named, 10-year federal/state/county criminal and sex-offender history check.
- For Medicaid/commercial payers: confirm state Medicaid or payer definition of technician qualifications, enrollment and credentialing before billing (state-specific).
Verify any certified technician on the BACB certificant registry.
