Getting a new technician started in New Mexico
New Mexico Medicaid is unusually friendly to a new BT: a person can start under a 'non-certified BT' approval after the criminal background registry check, 4 hours of ASD training and 20 hours of RBT-aligned training, and has up to six continuous months to earn the RBT (or BCAT) certificate. Plan the 40-hour training by day 90 and RBT test eligibility by day 180. Confirm the current rule with the employing ABA agency and the MCO, since the main source is a 2022 supplement. (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- Is the non-certified behavior technician pathway (Supplement 22-02, Jan 2022) still in force under Turquoise Care MCOs and the current NM Medicaid rules? The HCA site still listed a non-certified BT template dated 2024-10-16.
- Does the NM statute (59A-22-49) apply to self-funded ERISA plans? Not stated in the text we read; also confirm against the official NM statute site.
- Telehealth: current 8.310.2 NMAC and MCO rules on ABA telehealth modifiers, limits and telesupervision were not fetched.
- Confirm with the NM Regulation and Licensing Department that no state license exists for BCBAs (inferred from BACB list).
- Current Medicaid ABA enrollment steps and fees on YES.NM.GOV were not walked through.
- Any state-specific CPR/first aid or TB requirements for BTs were not found.
- medicaid_aba: verifier astra marked conflict - Replace the current rule citation with 8.321.2.13 NMAC, effective December 10, 2024; section .12 now concerns youth residential treatment. EPSDT applies below age 21, while ABA also covers adults; do not present 12 months as the rule's universal minimum. The three-stage structure remains supported: BCaBAs assist supervising BAs, and technicians assist Stage 2 and implement Stage 3 under supervision. Rendering eligibility does not establish independent billing authority. The credential list is outdated: CMS approved SPA NM-24-0008 on December 9, 2024, effective October 1, 2024, adding QABA and ABAT eligibility. Its BT provision requires one hour of case supervision per 10 intervention hours per individual. The mentor needs three years of BA supervisory experience. T1026 UD and the certification-supervision exclusion match the 2022 supplement; current billing instructions were not verified. Fee-for-service ABA also exists. The enrollment URL is linked by HCA, but its contents and the YES enrollment instructions could not be verified.
- bcba_licensure: verifier astra marked conflict - New Mexico is absent from the opened BACB table, and the university disclosure expressly supports no separate behavior-analyst license; the original caveat about inference remains appropriate because neither is an affirmative NM licensing-agency determination. The conflict is the Medicaid qualification sentence: BACB certification or BACB-recognized psychologist status is not an exhaustive current description. SPA NM-24-0008 adds QABA and specifies psychologist education/experience and another qualifying practitioner/supervisor pathway. Meanwhile, 8.321.2.13(B)(2) still describes BACB certification or ABPP certification in behavioral and cognitive psychology with ABA examination. Flag this mismatch between the approved state plan and NMAC rather than presenting the older formulation as settled.
- telehealth_aba: verifier astra marked conflict - Keep ABA telehealth allowed, subject to applicable requirements. The in-state licensing statement matches the supplement. Correct the out-of-state MD/DO statement to allow either a telemedicine license or a full NM medical license. Delete the assertion that the supplement gives no telehealth limits: its case-supervision and 97155 instructions address remote delivery, conditional store-and-forward use and exclusion of noncertified BTs from that option. Thus supervision_via_telehealth need not remain wholly unknown. No general permission for every ABA code or audio-only treatment follows. Current MCO-specific requirements and telehealth modifiers remain unverified; null parity and in-person fields must not imply that no laws or requirements exist.
- bt_vs_rbt: verifier astra marked conflict - The 2022 definition supports age 18, diploma/equivalent, background clearance, the listed ASD topics and four training hours, 20 credential-training hours before service, 40 hours of BACB-approved training within 90 days, testing prerequisites within 180 days, and certification within six continuous months or cessation of Stage 2/3 services. However, section 3.11.1 measures six months from first billing, creating an internal timing conflict. More importantly, the current approved state plan also recognizes QABA's ABAT, so RBT-or-BCAT-only is incorrect. That plan separately retains a documented-training pathway without RBT credentials; its silence about deadlines does not prove their repeal. The attestation listing was verified through the official legacy-domain copy, but its PDF and current implementation of the deadline were not verified.
