N.M. Stat. Ann. 59A-22-49 (individual/group health policies); NCSL also lists 59A-23-7.9, 59A-46-50 and 59A-47-45 (2009) for other plan types

Age limits

None. Subsection C of 59A-22-49 (FindLaw text, current as of 2024-01-01) says coverage for speech, occupational, physical therapy and applied behavioral analysis 'shall not be denied to an insured on the basis of the insured's age'.

Notes

As of the FindLaw copy (current as of 2024-01-01) the statute requires coverage of well-baby/well-child screening for autism and treatment through speech, occupational and physical therapy and applied behavioral analysis. Coverage is limited to treatment prescribed by the treating physician under a treatment plan, may be subject to general policy exclusions (coordination of benefits, participating-provider requirements, utilization review, medical necessity), and may exclude services that IDEA makes a school responsibility. Not applicable to Medicare supplement, long-term care, disability income, specified-disease, accident-only, hospital-indemnity or other limited-benefit policies. The statute text does not say anything about self-funded (ERISA) plans; that was not confirmed. Sources are a legal-publisher mirror and NCSL (page updated 2021-08-24), not the official NM statute site.
